ORDERING FROM US

Please note, WE RESERVE THE RIGHT TO REFUND ORDERS AND NOT SEND ORDERS WHICH HAVE BEEN GIVEN A ‘HIGH RISK’ RATING BY OPAYO/ELAVON, OUR PAYMENT PROCESSOR COMPANY.

Payments made online are taken via OPAYO. Credit card details are entered on a secured page and are transferred using SSL technology. MIDDLETON'S DAIRY LTD will never see or retain your bank or credit card details when you pay online. If not paying online we will contact you to arrange payment and delivery.

When you enter your order on our website it does not indicate that a contract exists between us. Once we deliver the items you have requested to where you have told us to deliver them, there is a contract between us.  We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Though we constantly strive to provide accurate and current information on this website, MIDDLETON'S DAIRY LTD, will not be responsible for errors/omissions in product descriptions or the customer’s interpretation of those descriptions.

Customers must be of 18 years or over to be able to place an order.

Registration as a customer must be accompanied by your real name, cardholders address, email address and any other requested information during the registration and order process.

Orders can be placed via our website until the cut-off time indicated on the information pages of this website. This cut-off time enables us to check the order and stock and load that order for your next delivery day (this does not imply a delivery next day if we do not deliver on your round every day), subject to availability.

We can accept cheques, cash, BACS/online transfers and the following credit/debit cards: MasterCard, Visa, Visa Electron, Visa Delta, Switch/Maestro.

We cannot send orders to P.O BOX addresses. We will not accept P.O Box addresses as a valid billing address, even if an order is attempted and payment is authorised by Opayo.

Your regular product order and any that you add to it or order specifically may not be delivered if payment on your account is overdue or your last payment was rejected by your bank or card.

PAYMENTS

All prices on this website are in UK pounds sterling and include VAT if relevant. Please note that currently VAT is not applicable to most food products. Prices are subject to change without notice. We are obliged to state that VAT applies to deliveries to UK and other European Union destinations. All other orders are VAT free.

Any quotation or published price is subject to alteration or withdrawal without prior notice as a result of fluctuation in exchange rates, increase in supplier’s prices, and error in published price or other costs beyond our control. Statement of price or a quotation does not constitute an offer. We will inform you of the correct price where the right to cancellation can be exercised.

Full payment is required on all orders when we request payment, usually after delivery. All card payments are subject to security checks before acceptance. If the issuing bank of your payment does not for any reason authorise payment from that account, we will try to contact you to obtain an alternative payment method. If we cannot obtain payment future orders may be delayed or cancelled.

Any account and its orders may be put on hold if a payment is not made on your account.

Monthly payers, that is to say those that choose to receive an invoice containing all items received the previous month, must clear their account within 14 days of receipt of each monthly invoice or request for payment.

PRODUCT AVAILABILITY

ALL GOODS ARE OFFERED SUBJECT TO AVAILABILITY. Items listed on our website are purely an invitation to order. They do not constitute that the item is in stock. We do not and cannot guarantee that every item on our website is available at time of ordering. If an item is ordered and we do not have stock then we will try to contact you to see if you would like an alternative product, or wish to wait while we obtain more stock, provided a correct email address and telephone number is provided by you. We reserve the right to withdraw any item without notice.

The produce images on our website are an indication of the product we are offering, however the packaging may vary.

GUARANTEE

All products are delivered in good condition at the time we deliver them and are fit for consumption within the dates specified by the producer/manufacturer on the packaging.

This will exclude products suffering damage, breakages, deterioration or contamination caused by accident, neglect, misuse or deliberate interference by others once the product is delivered to the place you specify at the delivery address. This includes where the product is left exposed to the elements, public or animals for any prolonged period. We therefore cannot accept responsibility for the condition the product is in once you actually consume it.

You may be responsible for transport and return any goods damaged after we have delivered them.

PRIVACY

We do not send unsolicited emails to our customers or potential customers. We may however send you information that relates to your order, your account or the status of this website. This may include making you aware of any changes to our trading terms, Roundsmen, delivery days, product prices or to advise you of new products or offers. Please indicate your preference of whether you receive such information from us when placing your order. You may unsubscribe at any time and inform us by replying to any email or newsletter that you receive from us.

We continually monitor web statistics including site usage and search engine patterns to help us develop the design and layout of our web site. This in no way affects our customers’ privacy.

We do not share our customers contact details with any third party other than the Company we employ to support and maintain this website and the software that it hosts, in order to operate your online account with us.

Any payment or card transactions you carry out via this website are encrypted and protected using SSL technology so that no one can see the details.

DELIVERIES

This information relates to UK Deliveries

Please note, we deliver our products to a place you specify at your delivery address. This is not always to you personally or even when someone is able to accept delivery. When ordering you are agreeing to us leaving the product(s) when and where you request us to do so, or on your doorstep if no other place is specified to us.

It is the customers’ responsibility to ensure the place you specify to us at the delivery address and location is suitable and safe from any interference or adverse conditions. It is also your responsibility to take the products delivered into your property promptly and store appropriately.

Deliveries are usually on the specific days that we are able to deliver at your location and agreed at the point we accept you as a customer. This can be between 2 and 6 days a week and may exclude some national holidays. You will be informed of the usual delivery days for your delivery ‘round’ when you first register with us as a customer.

We always attempt to deliver your orders when and where you request, however we cannot be held responsible for deliveries that cannot be made due to adverse weather conditions, local road conditions, staff illness, vehicle breakdowns, our suppliers non-delivery or other issues and incidents that are beyond our control.

All goods are carefully loaded and delivered as soon as they are available to fulfil your order. There are no charges for delivery to addresses within our delivery areas specified on our website.

A specific delivery time to any doorstop cannot be and is not guaranteed.  Upon placing your order a delivery time may be advised, however MIDDLETON'S DAIRY LTD shall not be held responsible should delivery be received after the advised time.

Title to the goods will remain with MIDDLETON'S DAIRY LTD until full payment is received.

CANCELLATION / RETURN OF GOODS

If, for any reason at all, you are not totally satisfied with your purchase please notify us as soon as possible or at least within 48 hours of delivery. If the product is found to have been faulty, sub-standard, out of (consumption) date when delivered or damaged in transit we will provide a full refund of the purchase price, or a replacement if agreed with you.

If you wish to cancel an order and it has already been delivered to you, then the product will be charged for. If you cancel an order within 48 hours of its requested due delivery, especially for a special product or offer we have obtained or reserved specifically for you, then the product may be charged for.

Unless faulty, we cannot accept the return of any special order or reserved products.

Whilst we will make every attempt to limit and remedy this type of situation, we must emphasise it is in everyone’s interest to ensure that the correct items are being ordered and that the delivery day and time is suitable for you.

Should you wish to cancel your deliveries all together, please note that you MUST call the office on 01433 651650. Simply removing your standing order may not cancel all your deliveries. Any deliveries made after you removing your standing order, may still be charged for.

If any part these terms and conditions shall be found to be unlawful it shall not affect the validity or enforceability of the remainder of the conditions. This contract is and shall be deemed to have been made in England and shall in all respects be governed by English Law.
